USER  AGREEMENT

 

 

PUBLIC AGENCY OFFER OF THE PMS.Rent PLATFORM

 

 

This document sets forth the terms and conditions governing the use of the PMS.Rent platform and constitutes a legally binding public agency offer. By accessing or using the service, the user is deemed to have accepted this Offer and agreed to be bound by its terms.

 

 

1.1. “Platform” (hereinafter — the “Platform”, “We”, “Us”) — the administration of the PMS.Rent service operated by the company PMS.Rent. The Platform provides a cloud‑based software environment for property management, data synchronization with online travel agencies (OTAs), operational control, payment automation, and reporting. The Platform operates within an international legal framework and interacts with users from multiple jurisdictions.

 

1.2. Owner (Principal) — an individual or legal entity that holds the lawful right to manage a Residential Property and entrusts the Operator with business management, while the Platform provides the technical infrastructure for operational processes.

 

1.3. Operator (Manager or Affiliated Agent) — a Platform user authorized by the Owner to perform comprehensive management of Residential Properties, interact with Guests, and administer financial operations. The Operator acts as the Owner’s authorized representative within the system and is responsible for the allocation of incoming funds.

 

1.4. Platform (Software Suite) — a software system that includes a Property Management System (PMS), synchronization through an internal Channel Manager, integration tools for international payment systems, and functionality for deploying websites with a direct booking module.

2.1. Technological access: The Platform provides the Owner and the Operator with access to its services for the automation of business processes, rental management, and guest acquisition. The Platform guarantees that its functionality complies with the current technical documentation and ensures access to the software environment in accordance with the accepted standards of quality for cloud services.

 

2.2. Agency model: The Owner authorises the Operator to act on behalf of and at the expense of the Owner in receiving payments from Guests, paying for the Platform’s services and third‑party services, and calculating the net income.

 

2.3. Risk‑free status of the Platform: The Platform is not the owner of any properties, does not receive payments from Guests, and bears no responsibility for the quality of accommodation. All transactions are concluded directly between the Owner and the Guest or between the Manager and the Guest.

 

2.4. Acceptance of the Offer: This Offer is deemed accepted by the User upon registration in the system, authorisation, or actual use of the Platform’s services. Use of the Platform constitutes full and unconditional acceptance of the terms of this Agreement.

3.1. Receipt of funds: All payments from Guests or booking channels (OTA) are credited to the accounts of the Operator (Manager/Agent). The Operator acknowledges these funds as transit amounts (net of its remuneration).

 

3.2. Operating charges: From the received funds, the Operator covers expenses necessary for the functioning of the Owner’s business, including: commissions of international booking channels (OTA); marketing and promotional costs (Google Ads, Facebook, Meta, etc.); services of the Platform’s technological partners ensuring system operation.

 

3.3. Operator’s income: The taxable income of the Operator is limited solely to its fixed remuneration for management services. All other amounts are recognised as reimbursable expenses incurred in the interests of the Owner.

4.1. Mutual settlements and transit payments: Based on the Platform’s data, the Operator makes payments as follows:

– Reimbursement to the Platform for transit operating expenses: payment for marketing (Google Ads and others), external API gateways, and partner services performed by the Platform in the interests of the Owner and the Operator;

– Payment of remuneration to the Platform: payment for providing technological access to the software environment and services;

– Retention of the Operator’s own commission: in accordance with the property management terms; Transfer of the (Net Income) to the Owner: the remaining funds after all deductions.

 

Note for banking operations: The Parties agree that payments in favour of the Platform may be made by a single payment order, with mandatory separation in the payment description between the amount of Remuneration and the amount of Reimbursement for transit expenses.


4.2. Role of the Platform in partner payments:
The Platform may, on its own behalf, engage third‑party partners to provide services (marketing, technical support, API gateways, payment systems, etc.). If the Platform pays for such services using the Operator’s funds, it acts solely as an Attorney (payment agent). These funds are recognised as transit amounts, do not constitute the property of the Platform, and are not included in its taxable income. The Platform’s income in this case is limited to the fixed remuneration (clause 4.1) and any technical transaction‑handling fee, if established.

 

4.3. Legal validity of data: Statements, invoices, and registers generated by the Platform’s accounting system are recognised by the Parties as sufficient evidence of service provision and settlement execution. The Platform’s services are considered fully rendered if no written objections are received within three working days after the reporting month. The Platform’s data shall prevail in the event of disputes regarding the amounts of transit expenses.

5.1. Responsibility for information: The Owner and/or the Operator authorised by the Owner bear sole responsibility for the accuracy and relevance of the Content (texts, photographs, accommodation conditions, prices) uploaded to the Platform.

 

5.2. Licence for promotion: By placing Content, the Owner grants the Platform and the Operator a royalty‑free right to use such Content (including photographs of the Property and trademarks) for publication in booking channels and in the Platform’s promotional materials.

 

5.3. Prohibited content: It is forbidden to upload materials that infringe the copyrights of third parties, as well as content of unethical, discriminatory, or unlawful nature. The Platform reserves the right to remove such content without prior notice.

6.1. Technical nature of the service: The Platform is a complex IT product under continuous development. We undertake all commercially reasonable efforts to ensure the availability of services 24/7; however, we do not guarantee the absence of temporary interruptions caused by maintenance work or issues on the side of external providers (booking channel APIs, payment gateways).

 

6.2. Allocation of liability: The Platform shall not be liable for financial disputes between the Owner, the Operator, and the Guest; actions of the Operator related to the distribution or non‑distribution of funds; the safety of property or the conduct of Guests; or losses arising from incorrect configuration of booking parameters by the Operator or the Owner.

 

6.3. Moderation and blocking: The Platform reserves the right to restrict access or block a User’s account in cases of repeated complaints from Guests or booking channels, or in the event of a breach of this Agreement.

 

6.4. Force majeure: The Parties are released from liability for failure to perform their obligations due to circumstances of force majeure, including communication network failures, natural disasters, military actions, epidemics, decisions of governmental authorities, and other circumstances beyond the reasonable control of the Parties.

7.1. GDPR status and data processing: The Platform acts as a Data Processor, while the Owner and the Operator act as Data Controllers in accordance with Regulation (EU) 2016/679 (GDPR). The Platform ensures that data are processed solely within the scope of service provision and are not transferred to third parties without a lawful basis.

 

7.2. Purposes of processing: The Owner and the Operator consent to the processing of personal data (their own and those of Guests) exclusively for the purposes of the Platform’s operation, synchronisation with external services, and settlement procedures. The Operator undertakes to independently ensure that Guests have granted consent for the transfer of their data to the Platform.

8.1. Applicable law and official language version: This Agreement is governed by the principles of international private law and the legislation of the country where the Platform is registered. The official version of this Agreement for the purposes of legal interpretation is the English version.

 

8.2. Dispute procedure: All disagreements shall be resolved through negotiations (claim procedure — 30 days). If a compromise cannot be reached, the dispute shall be submitted to the competent court at the place of registration of the Platform.

 

8.3. Legitimacy of use: If the legislation of the Owner’s or Operator’s country prohibits the use of cloud systems for rental automation, the User must immediately cease using the Platform.

9.1. Communication: Official notices shall be sent to the following address:  legal@pms.rent. The Platform may send notifications to the User through the system interface or by email.


9.2. Amendment of terms:
The Platform reserves the right to amend this Agreement. The new version enters into force upon its publication. Continued use of the Platform after publication of the amendments constitutes full acceptance of such amendments by the User.


9.3. Termination of Platform use:
The User may discontinue use of the Platform at any time. The Platform may suspend or terminate access in the event of a breach of this Agreement or for technical reasons, notifying the User through the system interface or by email.


9.4. Language versions of the Agreement:
This Offer is issued in multiple languages. In the event of any discrepancies, contradictions, or differences in interpretation between versions in different languages, the English version shall prevail and have superior legal force.

Terms of Service

 

 

If you do not agree to comply with these Terms, please do not register, access, view, or use the services of the PMS.Rent Platform.

 

Please note that clicking the “Accept” button, attempting to log in or register, obtaining access, providing personal information, or using any services of the PMS.Rent Platform constitutes your full and unconditional acceptance of these Terms. If you do not wish to accept this Agreement, please refrain from performing the above actions and do not use the Platform’s services.

 

 

 

1.1. PMS.Rent (hereinafter referred to as the “Platform”) is a technological complex (SaaS) that provides a digital infrastructure for automating property management.

 

1.2. The Platform ensures technical connectivity between Property Owners, Managers, and global sales channels (including Booking.com, Airbnb, and others).

 

1.3. These Terms constitute a public document and govern the use of the Platform’s services by all categories of users.

2.1. Full access to the Platform’s functionality is granted after completing registration and providing accurate and verifiable information.

 

2.2. The User obtains the right to use the Platform for commercial management of property rentals.

 

2.3. Trial Period: New users are granted free access for one month to explore and test the system. If no activity is detected in the account after 30 days, the Platform reserves the right to restrict access.

3.1. Pay‑After‑Earnings Model: The Platform does not charge a fixed subscription fee. The Platform withholds its remuneration only from bookings that have actually been completed.

 

3.2. Agency Model: All financial settlements are based on an agency structure. Funds intended for advertising expenses (Google Ads, Meta) or for transfers to Property Owners are considered transit funds and do not constitute income of the Platform.

 

3.3. Payouts: Income transfers are processed through integrated payment systems (including Wise) within 24–48 hours after the Guest’s check‑in.

 

3.4. Transaction Records: The data generated by the Platform’s internal accounting system is recognized as the sole and sufficient confirmation of all completed transactions and the provision of services.

4.1. API Synchronization: The Platform provides instant synchronization of pricing and availability across all connected channels, minimizing the risk of double bookings.

 

4.2. Content Responsibility: The Property Owner or Manager bears full responsibility for the accuracy of descriptions, photographs, and pricing information uploaded to the system.

 

4.3. Direct (Personal) Bookings: Users may manually add bookings obtained independently to the calendar free of charge; the Platform does not charge any commission for such bookings.

5.1. The cancellation policy is set individually by the Property Owner for each property.

 

5.2. In the event of a cancellation of a confirmed “Instant Booking,” the responsible party may be subject to penalties imposed by international booking channels (OTA).

 

5.3. Systematic or unjustified cancellations may result in account suspension without the right to restoration.

6.1. The Platform is solely a technological tool.

 

6.2. The Platform is not a party to disputes between the Property Owner, Agent, and Guest and bears no responsibility for their financial or domestic conflicts.

 

6.3. The Platform does not guarantee 100% accuracy of user‑provided data and is not liable for losses arising from interactions between users.

7.1. The Platform provides technical support to users regarding system operation via email and online communication channels.

 

7.2. The Platform is continuously evolving. We reserve the right to modify functionality and update these Terms to improve security and service quality.

 

Privacy Policy

 

 

Please read this Privacy Policy carefully. Using the PMS.Rent Platform means that you agree to the terms set out below. If you do not agree with the conditions of this Privacy Policy, please do not use our Platform.

 

1.1. The PMS.Rent Platform takes the protection of your confidential information seriously. We process personal data in accordance with international legislation, including the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679), where applicable.

 

1.2. This Privacy Policy applies to all users and all services provided through the Platform. By using the Platform, you confirm your full agreement with this Policy and authorize the automatic processing of your personal data for the purposes specified herein.

We collect your data in the following cases:

  • when you visit the Platform;
  • when you create an account;
  • when you list properties on the Platform;
  • when you contact us through the Platform interface or by email;
  • when you interact with the Platform’s functionality (for example, adding properties to favorites).

3.1. We process the following categories of personal data:

  • Personal Information: first name, last name, region of residence, email address, contact phone number.
  • Financial Data: payment details required for transferring income through the Wise payment system.
  • Property Information: descriptions, photos, addresses, and prices of real estate properties.
  • Technical Data: IP address, cookies, activity data on the Platform, and information used for fraud prevention.
  • Communications: messages, letters, and comments exchanged through the Platform.

 

3.2. We also automatically collect data about visits to the Platform and interactions with its interface, including cookie data.

 

3.3. Within the Platform’s operations, PMS.Rent processes data necessary for transactions between users, sending notifications, and performing payments.

 

3.4. Information required for publishing properties is requested when creating an account.

Access to personal information is provided only to the account owner — the property owner, property manager, or agent.
You can independently update, modify, or delete your data in your profile.

5.1. Your data is used solely to fulfill the Platform’s obligations:

  • to ensure the operation of the Platform and your account;
  • to automate property listings on international booking platforms (Booking.com, Airbnb, Expedia, etc.);
  • to process payments and transit transactions (for example, Google Ads);
  • to protect your account (password verification, monitoring suspicious activity);
  • to send notifications about bookings, updates, and project news.

 

5.2. By registering on the Platform, you agree to receive informational emails. You may unsubscribe at any time.

 

5.3. In the event of a sale or transfer of the Platform to another owner, PMS.Rent reserves the right to transfer your data to the new operator without additional consent.

 

5.4. PMS.Rent does not share your personal data with third parties except as required by law or necessary for service operation.

You have the right to:

  • view and edit your personal data;
  • withdraw consent for data processing (“right to be forgotten”);
  • request deletion, correction, restriction, or transfer of your data;
  • opt out of marketing communications.

To exercise these rights, please contact our support team.

We apply modern technical and organizational security measures to prevent loss, alteration, or unauthorized access to your data by third parties.

We store data only as long as necessary to fulfill the purposes for which it was collected.
After the retention period expires, the data is permanently deleted.

The Platform may update this Policy without prior notice.

1. Getting Started and Costs

No, registration and listing any number of properties in the system are completely free. We do not charge subscription fees or hidden payments. The platform earns only when you earn. The system’s commission is already included in the price shown to the guest on the booking site, so you always receive your “net” amount without any additional deductions.

Any properties suitable for short‑term rental: apartments, villas, guest houses, townhouses, mini‑hotels, hostels, or individual rooms. The main requirement is your legal right to manage and rent out the property.

Anyone who wants to manage short‑term rental properties — their own or others’. No special education, license, or experience is required. You only need the desire to work and the willingness to learn how the platform functions.

If the property is managed by a Manager:

The Manager registers independently with distribution partners (OTAs and other channels) such as Booking.com, Airbnb, Expedia, Vrbo, Google Travel, and travel agencies. After connecting partners, the system automatically synchronizes property data, calendars, prices, and availability. The Manager does not need to manually create listings on each site — the platform ensures automatic distribution of information across connected channels and keeps them up to date.

 

If the property belongs to an Owner working through an Agent:

The Owner does not register with OTAs and does not perform technical setup — all channel connections and management are handled by the Agent. The Owner can enable distribution through booking channels or keep the property available only on the Agent’s website if they prefer a local model of operation.

 

Thus, the system does not register properties automatically but provides full automation of distribution and synchronization once partners are connected. This allows you to receive bookings from global platforms without manual work and maintain high data accuracy across all channels.

2. Legal Matters

No. The relationship between users and the platform is governed by a public Offer (User Agreement) published on the PMS.Rent website and also available in the admin panel as a downloadable file. The public Offer is a legally binding contract that takes effect automatically at the moment the service is used.

 

This contract format fully complies with the legislation of all European countries and is widely used in the field of online services, SaaS platforms, and digital products.

 

Therefore, users do not need to sign additional contracts or go through separate legal procedures — it is sufficient to accept the terms of the Offer during registration or while using the platform.

PMS.Rent does not regulate the relationship between Owners and Managers/Agents. All terms of cooperation, payment, responsibility, and interaction are determined independently by the parties.

 

If the Owner works through an Agent:

PMS.Rent does not regulate contractual relations between the Owner and the Agent. Agents usually use their own public Offer (agreement with Owners), which defines the terms of cooperation, payment procedures, and responsibilities of both parties.

 

Such an Offer is published on the Agent’s website and duplicated in the Owner’s personal account, where it can be viewed and downloaded. Acceptance of the Offer’s terms is legally sufficient and does not require signing separate paper contracts.

 

If the Manager works with Owners’ properties:

In this case, the Manager determines the form of agreement with the Owners whose properties are managed. Since the Manager does not have a personal website and the platform does not provide a standard agreement template, the Manager independently chooses an appropriate form of cooperation — in accordance with the legislation of their country and the established practice in the short‑term rental industry.

 

PMS.Rent does not interfere in these relationships and is not a party to such contracts. All terms of cooperation, payment, responsibility, and interaction are defined independently by the Manager and the Owner, taking into account the legal norms of their jurisdiction.

PMS.Rent was created based on many years of practical experience of property owners and managers working with dozens of listings. The platform:

  • allows you to start a business without initial capital;
  • does not require purchasing licenses or subscriptions;
  • automates work with global booking channels;
  • is suitable for both individuals and companies;
  • enables one person to efficiently manage 30–50 properties;
  • operates entirely in the cloud and requires no installation of software or applications.

3. User Work Formats

Property Manager:

  • Manages their own properties or those belonging to Owners.
  • Adds Owners and properties independently.
  • Can edit all property details and Owner information.
  • Cannot provide Owners with access to their own property dashboard.
  • Does not have a personal website for Owners to register independently.

 

 Affiliated Agent:

  • Has their own website based on the platform.
  • Owners can register independently on the Agent’s website.
  • Can view all information about Owners and their properties.
  • Cannot edit Owners’ data or property details.
  • Can block an Owner’s account in case of violations or complaints.

Yes. If an Agent plans to grow their business, attract new Owners, and manage a large number of properties, having a personal website is an essential tool. Yes, this option is available. Although a website is not required for Managers working with a small number of properties, they may create their own website if they wish and use it to promote their services.

 

If a Manager plans to work with a large number of properties (usually 50 or more) and has marketing skills, they may contact the PMS.Rent administration for assistance in creating and connecting a website. This is permitted by the platform’s policy and does not contradict its principles.

4. Money, Taxes and Payments

All settlements are fully automated. We work with the international payment system Wise, which enables income payments to most countries worldwide and in almost any currency. Depending on the policy of the payment partner, payments are made within 24–48 hours after the guest’s check‑in and usually arrive within two banking days. If you have a Wise account, the transfer is instant. Payments can be sent either to an IBAN account in euros or to any other account in a different currency.

We use a transparent “expense reimbursement” model. Only your actual income — that is, your commission — is subject to tax. Funds that pass through payment partners or are spent on advertising are not considered your income and do not increase your taxable base.

 

The platform generates clear financial reports that can be used for filing tax returns and submitting to the tax authorities of your country.

 

The legal framework of operation is based on public agreements (Offers) accepted through consent. These agreements govern the relationships between the platform and Operators (Managers and Agents), as well as between Operators and Owners. This model fully complies with European legislation and ensures proper allocation of income and tax obligations.

The platform supports multiple currencies available through Wise, allowing users to choose the most convenient currency for receiving payments and conducting transactions. 5. Management, Risks and Safety

That is impossible. The platform instantly synchronises calendars. As soon as a booking is received, for example from Airbnb, those dates are immediately closed on Booking.com and other platforms.

Listings on OTAs are usually available only under the “Instant Booking” status. Refusing such bookings significantly lowers your property’s ranking in search results, and repeated refusals may lead to additional negative consequences from the platforms.

 

Cancelling an already accepted booking usually results in penalties ranging from 25% to 100% of the daily rate of the property, depending on the policy of the specific OTA or other partner. In cases of repeated cancellations, the platform or partner system may automatically block your account together with all your properties.

No. All management takes place in the cloud. You can change prices, upload photos, or reply to guests directly from your smartphone anywhere in the world.

We recommend taking a security deposit in cash upon check‑in and returning it upon departure after inspecting the property. This is the most reliable and quickest way to protect yourself.

Knowledge of English is an advantage but not essential. Booking websites have built‑in translators, and for personal communication you can use applications such as Google Translate.

Yes. The system includes a “Block for personal use” function. You simply mark the required dates, and the property is removed from sale on all websites.

You are protected by the cancellation policy that you choose yourself. If the guest does not arrive, you will receive compensation according to your selected terms.

6. Technical Capabilities

Yes. You can connect your own domain or use a free subdomain in the format: https://name.pms.rent. If you already have a domain, you simply link it. If you do not have one, you can purchase it from any registrar. The domain is registered in your name and remains yours even after you stop using the platform.

No. The platform is entirely cloud‑based and operates through a web browser. No installation, updates, or technical maintenance are required.

Yes. We offer a free one‑month trial period. If you do not start active work after the trial, your account will be automatically blocked. Thirty days after blocking, it will be deleted. Once deleted, you will not be able to reuse the same email address.

7. Legal Responsibility and International Use

The platform provides the technical infrastructure for managing properties and bookings but is not a party to the contract between the guest and the owner. The Manager or Agent is responsible for the accuracy of data, compliance with legislation, and fulfilment of obligations towards guests and owners.

The platform can be used in any country where short‑term rental is permitted. However, since all payments are processed through the Wise payment system, it operates only with the countries listed in its official directory. Therefore, before starting registration on the platform, please check this list.
